Managing Unauthorised Encampments

Occasionally, unauthorised encampments are set up on land within the borough of Ribble Valley and sometimes there is confusion as to who is responsible for removing such unauthorised encampments. The guidance below has been produced to help clarify responsibilities.

Unauthorised Encampments on Private Land

Where an unauthorised encampment occurs on private land, it is the landowners/tenants responsibility for ending the occupation of the land and not the local authority. Landowners and tenants must check the terms of their lease agreement to determine responsibility.

Landowners/tenants can talk to the Gypsies and Travellers to establish if a leaving date can be agreed. If a leaving date cannot be mutually agreed, a landowner/tenant can apply to the County Court for an eviction order, requiring the Gyspies and Travellers to leave the site by a given date. It is recommended landowners/tenants seek legal advice prior to taking this course of action.

Unauthorised Encampments on Council Land

Where an unauthorised encampment occurs on borough Council land i.e. recreational parks, the Council will be responsible for undertaking eviction proceedings.

The Council will also be responsible for clearing the land of waste, and any other articles, after the encampment moves on.

Preventative Measures

Below are simple measures that can be adopted by landowners to minimise the risk of unauthorised encampments:

  • Use fencing, bollards, height barriers and gates to restrict access.
  • Always repair or replace damaged or stolen padlocks and gates.
  • Encourage staff and neighbours to report attempts to gain access to land.
